Notice of Privacy Practices (HIPAA)

Day by Day Trauma Therapy is committed to protecting your health information (PHI) as required by HIPAA and Kentucky law. This Notice explains how your information may be used and disclosed, and the rights and responsibilities you have in relation to your records. Please read it carefully—it is your responsibility to stay informed.

You have important rights. You may request written copies of your records, which will be prepared within 10 days and may involve reasonable fees. You may request an accounting of certain disclosures and obtain a paper copy of this Notice at any time. If you have a guardian or power of attorney, that person may exercise your rights. Written releases are necessary to coordinate care with other providers, and they are also required if you choose to bring additional people into a session.

You also have choices in how we share information. We may share details with family or others involved in your care, during disaster relief, or leave appointment reminders. We do not engage with clients on social media or acknowledge online reviews to protect confidentiality, and we ask that you do not use social platforms for communication. Please note that anything you choose to share publicly is no longer private or protected.

As a client, you are responsible for reading this Notice, keeping your contact information current, communicating your confidentiality preferences, using only approved contact methods (phone, secure portal, or authorized email), and raising any concerns about your care or privacy.

Day by Day Trauma Therapy is not a 24/7 crisis center. In emergencies call 911 or go to the nearest emergency department. Please also consider Four Rivers Behavioral Health (270) 753-6622. For urgent mental health crises, dial 988 (Suicide & Crisis Lifeline).

Messages received after business hours will be returned the next business day.

In some situations, we may use or disclose PHI without authorization if required by law—for example, to report abuse or neglect, comply with court orders, assist law enforcement, or support public health and safety. PHI may also be disclosed for oversight, audits, research, workers’ compensation, or national security purposes. Psychotherapy notes receive additional protections and are rarely released without your written consent.

Kentucky law provides added protection for counselor‑client communications. Records are not released without your written permission except where required by law. If state law offers stronger protection than HIPAA, Kentucky law will apply.

We provide telehealth and electronic communication services using secure platforms. While safeguards are in place, no system is completely secure. We also work with business associates such as billing and telehealth providers, who are contractually required to protect your PHI.

This Notice may be updated periodically. Current versions will be posted in our office and on our website.
